This paper describes and analyse the Intellectual Property Rights (IPR) elements in the recently announced EU new trade policy, which seeks to be more assertive in global trade. The policy's focus on IPR covers pushing for greater global harmonisation, the implementation of stronger standards in bilateral FTAs, and enhanced enforcement efforts in key developing countries. This policy is largely similar to the IPR emphasis in US global and bilateral trade policy, which has had a record of mixed success. Lessons are drawn from that record to illuminate the potential gains and problems that might arise in the new EU trade policy.

Erschöpfungsgrundsatz im Patentrecht. Parallelimporte patentrechtlich geschützter Produkte. Die Frage der Zulässigkeit von Parallelimporten im Patentrecht ist weder im nationalen noch im für die Schweiz geltenden internationalen Recht geregelt, weshalb von einer echten Lücke auszugehen ist (E. 1-3). Die traditionelle schweizerische Rechtsauffassung, die Rechtsvergleichung sowie eine Abwägung der betroffenen Interessen sprechen für den Grundsatz der nationalen Erschöpfung im Patentrecht, zumal die Unterschiede zwischen Marken- und Urheberrecht einerseits und Patentrecht anderseits eine einheitliche Behandlung der Erschöpfungsfrage nicht als zwingend erscheinen lassen (E. 4-8). Auf patentrechtliche Einfuhrmonopole kann das Kartellrecht Anwendung finden (E. 9).

Any Swiss-US free trade agreement should have an investment chapter because bilateral foreign investment is the bedrock of Swiss-US commercial relations. A closer look at investment policies and other issues relevant for investors reveals the value-added of an investment chapter. The mutual benefits of an investment chapter flow from high standards of investment protection, a standstill in discrimination at the sub-federal level, and zero tariffs on imports. Investment protection would be improved by access to the international investor-to-state dispute settlement system of ICSID. India, Brazil and South Africa belong to the most intractable blocking actors in the Doha Round. In order to explain this posture, reference is frequently made to the lack of willingness to compromise on the part of the other central actors EU and USA. In addition, the three countries' interests in the construction of an alliance of the South are cited as motivation for blocking the negotiations. This paper, however, accepts that trade policy is a two-level game and shows that the configurations of national decision processes in India, Brazil and South Africa and the resulting influence of specific interest groups significantly contribute to consolidating the blockade position. Against this backdrop, the authors are sceptical about the prospects of a compromise solution to the Doha Round.
