Bilateral free trade agreements are mushrooming all over the world. The current standstill in multilateral trade negotiations will contribute further to this trend. The growing number of free trade areas has resulted in an increasing importance of preferential rules of origin. Regularly, these instruments are used as protectionist devices. Rules of origin are becoming obstacles for international trade. In this paper, firstly the various types of rules of origin and their administration will be explained. The analysis of the consequences for international trade shows that rules of origin can produce trade diversion. The attempts of the European Union to reduce the welfare-reducing effects of free trade areas by creating pan-European rules of origin have been only partly successful. The rules of origin in the North American Free Trade Agreement (NAFTA) show a clear protectionist bias in some product groups.

When the General Tariff and Trade Agreement was initiated in 1947, the goal of this system was the mutual opening of national markets. In the meantime, the created world trading order is in danger to split apart into regional markets. The World Trade Organization (WTO) currently counts 200 trade unions, free trade areas, preferential agreements and economic partnerships that went back to introducing their own tariffs, distanced themselves from the most favoured nation and national treatment clauses and created additional trade barriers such as certificates of origin. Taking into account that international tax competition is going stronger, first arguments in favour of abolishing corporate income taxation or even any capital income taxation are presented. Second, the arguments in favour of capital income taxation and especially of corporate income taxation are discussed. There, we also consider those arguments which explain differences in the behaviour of "small" compared to "big" countries. Then, we describe the recent international development of corporate income taxation and especially the Swiss situation in the international corporate income tax competition.
