In recent decades a broad range of non-state actors ranging from multinational firms to non-governmental organizations have become key players in development finance alongside more traditional players such as official aid agencies and multilateral institutions. More recently they have been joined by a host of interested parties including social entrepreneurs, former politicians and celebrities, who have used their profile to raise awareness and leverage resources for international aid in developing countries. It was in the 1990s that the development-driven public-private partnership (PPP) modality gained traction and has since become the preferred instrument of development policy-makers in fields such as global health and, more recently, agriculture. The popularity and perceived utility...

There is nearly unanimous consent among WTO practitioners and scholars that the remedy of tariff compensation is legally superior, economically more efficient and socially more beneficial than retaliatory suspension of tariff concessions (tariff retaliation). This article argues in favour of a revitalization of tariff compensation. However, under the current regime compensation is a thoroughly unattractive policy instrument for decision makers having to temporarily opt out of a WTO Agreement in reaction to domestic shocks. Hence, tariff compensation is vastly underused. We examine reasons for the relative unattractiveness of this policy instrument and propose a substantial reform agenda of the WTO agreements and the dispute settlement system, so as to make compensation a policy tool of ...

In recent policy debates in Europe, the question 'what has competition done for Europe?' has been posed at the highest levels. This question merits careful reflection. Competition as it is understood by mainstream economic and legal scholars refers not to an ideology but to inter-firm rivalry in markets. Such rivalry ensures that consumers enjoy choice, low prices, and good value for money. The authors consider the historical origins and development as well as the current role and effects of competition policy in Europe. The latter includes legal provisions that address anti-competitive practices by firms and activities aimed at promoting competition in respect of potentially anti-competitive government measures. They conclude that such policy has made essential contributions to the hig...

The idea of profiting from biodiversity conservation may seem strange, but this is in fact an essential condition for mobilizing private investment in conservation. Without profit, business dies and markets stagnate, notes a major new study, Building Biodiversity Business, which has been underwritten by the International Union for Conservation of Nature and Natural Resources and Shell International. From forestry and fisheries to bioprospecting and ecotourism, biodiversity conservation can be profitable, the 164-page study suggests. It identifies business opportunities and proposals of concern to exporters, with particular emphasis on upcoming markets. The use of legally mandated biodiversity offsets is growing, and examples can be found in Australia, Brazil, Canada, Switzerland and the...

In everyday conversations, people express their worries about unemployment and inequality, about the brain drain and immigration, about civil conflict or environmental damage. What many people do not know is that international trade can be part of the solution. In countries where opportunities for development are scarce, trade matters even more in the fight against poverty. Without wider public support and understanding of international trade and development issues, it will be hard for initiatives to succeed. People who could speak out about the benefits of trade have neither done it well nor gone beyond limited circles. Trade can be a complex issue to explain. Leaders in trade, development and finance in least developed countries do not always communicate properly with each other, for ...

Looking back over the first four years of negotiation of the Doha Round this paper identifies and discusses a number of factors that are shaping negotiations among WTO members as they try to fulfil the development mandate for this multilateral trade negotiation. These factors are not just diplomatic in nature, indeed many relate to changes in how many view the potential impact of further multilateral trade rules and the 'legacy' effects of existing rules. Some of the proposed changes to WTO governance processes are assessed in the light of these considerations, and many are found wanting. The paper concludes that the fundamental implications of adopting a development mandate have not yet been comprehensively taken on board by WTO members and their officials.
